Telephone Consumer Protection Act (TCPA)

Holding Companies Accountable for Illegal Calls

A telemarketer’s call always seems to come when you’ve just sat down to dinner after a long day or as you are rushing out the door. Often the voice on the other line persists in trying to sell you magazine subscriptions or some other product even after you indicate that you are not interested. Or worse, you receive an automatic recording that plays regardless of your response.

These calls are one of life’s irritations. They may also be illegal. If you are experiencing intrusive or annoying telephone calls, the Rochester, NY attorneys at the Law Offices of Kenneth Hiller, PLLC, may be able to help you. Under the Telephone Consumer Protection Act (TCPA), consumers may be able to obtain compensation for each illegal call that a company makes.

About the Telephone Consumer Protection Act

The TCPA is a federal law enacted in 1991 to protect consumers from harassing telemarketer calls. It applies to a wide range of businesses that have used illegal telephone techniques to sell products and services such as insurance policies, magazine subscriptions and car warranties. Debt collectors may also be covered, meaning that it may be illegal for these agencies to make robocalls about your debts:

Under the TCPA, solicitors are prohibited from:

  • Calling homes before 9 a.m. or after 9 p.m.
  • Using recordings or artificial voices for solicitations
  • Sending unsolicited advertising by fax or cellphone
  • Calling consumers who have placed themselves on a do-not-call list or the national Do Not Call Registry

If telemarketers violate this law, you may be able to hold them accountable under the TCPA. You may be able to obtain compensation for every call made in violation of this law. If a court finds that calls were made willfully, the company may also have to pay punitive damages.
